These Terms of Service (“Terms”) govern your access to and use of the Concrete Pilates website located at concretepilates.com (the “Site”), and any purchases, bookings, memberships, class packs, private sessions, events, gift cards, or other services offered by Concrete Pilates (“Concrete Pilates,” “we,” “us,” or “our”). By using the Site or purchasing/booking any services, you agree to these Terms.

If you do not agree, do not use the Site or purchase services.

  1. ELIGIBILITY
    You must be at least 18 years old to purchase services or create an account on the Site. If you are under 18, a parent or legal guardian must purchase and sign any required waivers/agreements on your behalf.

  2. SERVICES AND BOOKINGS
    A) Service-based offerings
    Concrete Pilates provides fitness and wellness services, including but not limited to group Pilates classes, private sessions, memberships, packages/class packs, workshops, and events (collectively, “Services”). Service descriptions, pricing, and availability may change at any time.

B) Scheduling and availability
Bookings are subject to availability and may be limited by class capacity. We reserve the right to refuse, cancel, reschedule, or modify Services at our discretion, including for safety, instructor availability, facility issues, or other operational reasons.

C) Account responsibility
If the Site allows account creation, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

  1. PAYMENTS, PRICING, AND TAXES
    A) Payments
    All purchases are processed through Squarespace and/or its integrated payment providers (and any scheduling/booking tools you connect). You agree to provide current, complete, and accurate billing information.

B) Pricing
Prices and promotions may change at any time. Unless otherwise required by law, pricing changes do not apply retroactively to purchases already completed.

C) Taxes
Applicable taxes may be added at checkout where required.

  1. MEMBERSHIPS, PACKAGES, AND AUTO-RENEWALS
    (Include only what applies. If you don’t offer memberships, remove this section.)

A) Membership billing
Memberships may be billed on a recurring basis (e.g., monthly) beginning on the purchase date unless otherwise stated. By purchasing a membership, you authorize recurring charges until you cancel in accordance with these Terms.

B) Cancellation
To avoid a renewal charge, you must cancel at least [7] days before your next billing date. Cancellations take effect at the end of the current billing period unless otherwise stated. Membership fees already paid are non-refundable except where required by law.

C) Pauses/holds
Membership pause requests (if offered) are subject to approval and may require notice and/or documentation. Any pause policies will be disclosed on the Site or in studio policies.

D) Expiration and non-transferability
Unless otherwise stated, memberships and packages are non-transferable and intended for use only by the purchaser.

  1. CLASS PACKS, SESSION PACKAGES, AND EXPIRATION
    (Keep if you sell packs.)

Class packs and private session packages may have an expiration period stated at purchase (e.g., [X] days/months). Unused classes/sessions may expire and are not redeemable for cash unless required by law. Packs are non-transferable unless explicitly stated otherwise.

  1. CANCELLATION, RESCHEDULING, NO-SHOWS, AND LATE ARRIVALS
    A) Client cancellations
    To cancel or reschedule a class/session without penalty, you must do so at least [X] hours before the scheduled start time. Late cancellations may result in a fee and/or loss of the class credit.

B) No-shows
Failure to attend without canceling may be treated as a no-show and may result in a fee and/or loss of the class credit.

C) Late arrival
For safety and to preserve the class experience, late entry may be denied after [X] minutes. If denied entry, the booking may be treated as a late cancel/no-show.

D) Studio cancellations
If we cancel a class/session, you will receive a credit, reschedule option, or refund as required by law and consistent with the booking type.

  1. REFUNDS AND ALL SALES FINAL
    Because Services are time-based and capacity-limited, all sales are final unless otherwise stated on the Site or required by law. We do not offer refunds for unused classes, missed sessions, or partially used memberships/packages. Limited exceptions may be made at our sole discretion for extraordinary circumstances.

  2. GIFT CARDS
    Gift cards (if offered) are non-refundable and may not be redeemed for cash except as required by law. Lost or stolen gift cards may not be replaced unless we can verify purchase and remaining balance.

  3. HEALTH, SAFETY, AND ASSUMPTION OF RISK
    A) Not medical advice
    Concrete Pilates provides fitness instruction and is not a medical provider. Nothing on the Site or in our Services is medical advice. Consult your physician before beginning any new exercise program, especially if you are pregnant, injured, have a medical condition, or have concerns about your health.

B) Assumption of risk
Participation in Pilates and fitness activities involves inherent risks, including but not limited to muscle strains, sprains, falls, illness, or other injuries. By participating, you voluntarily assume all risks, known and unknown, associated with your participation.

C) Waiver and release
You may be required to sign a waiver/release of liability prior to participating in Services. If there is any conflict between these Terms and a signed waiver, the waiver controls regarding liability and risk.

D) Studio rules
You agree to follow all studio policies, safety instructions, and instructor guidance. We may refuse participation or remove you from a class/session if we believe your participation may pose a risk to you or others or if you нарушate studio rules.

  1. CLIENT CONDUCT
    You agree to behave respectfully toward staff and other clients. Harassment, abusive behavior, discrimination, or unsafe conduct may result in removal from the studio and termination of memberships/packages without refund.

  2. INTELLECTUAL PROPERTY
    All content on the Site (text, images, logos, graphics, videos, design, and other materials) is owned by Concrete Pilates or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

  3. USER CONTENT (IF YOU SUBMIT REVIEWS, COMMENTS, PHOTOS)
    If you submit content to us (e.g., reviews, testimonials, photos, videos, social tags), you grant Concrete Pilates a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content for business purposes, including marketing, unless you explicitly revoke permission in writing. You represent you have the rights to the content you submit.

  4. THIRD-PARTY SERVICES AND LINKS
    The Site may integrate or link to third-party services (Squarespace hosting, payment processors, scheduling tools, analytics, social platforms). We do not control and are not responsible for third-party services, their availability, or their privacy practices. Your use of third-party services is governed by their terms and policies.

  5. DISCLAIMERS
    THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  6. LIMITATION OF LIABILITY
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCRETE PILATES AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO CONCRETE PILATES FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Some states do not allow certain limitations, so parts of this section may not apply to you.

  1. INDEMNIFICATION
    You agree to defend, indemnify, and hold harmless Concrete Pilates and its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) your misconduct.

  2. DISPUTE RESOLUTION AND GOVERNING LAW
    A) Governing law
    These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

B) Venue
Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Maricopa County, Arizona, unless otherwise required by law.

C) Optional arbitration clause (use only if you want it)
If you want disputes handled by arbitration instead of court, tell me and I’ll add an Arizona-appropriate arbitration section.

  1. CHANGES TO SERVICES OR TERMS
    We may update the Site, Services, studio policies, pricing, and these Terms at any time. Updated Terms will be posted on this page with a revised Effective Date. Your continued use after changes means you accept the updated Terms.

  2. TERMINATION
    We may suspend or terminate your access to the Site or Services if you violate these Terms or studio policies, if your conduct is unsafe, or as otherwise necessary to protect the studio, clients, or business operations. Termination may occur without refund except where required by law.

  3. SEVERABILITY
    If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

  4. ENTIRE AGREEMENT
    These Terms, together with any posted policies (including the Privacy Policy) and any waivers you sign, constitute the entire agreement between you and Concrete Pilates regarding your use of the Site and Services.
